Modernisation of European Competition Law

The first annual competition law conference of the Centre for a Common Law of Europe took place in Leuven in June 2001. The conference was devoted to lsquo;Modernisation of the application and enforcement of European Competition Lawrsquo;.br br The modernisation idea had been launched by the Commission in 1999 in a White paper which, at the time of the conference, had already been followed by a draft Regulation that would replace the famous ldquo;Regulation No. 17rdquo; relating to the implementation of Articles 81 and 82 EC. The Commission proposes to dramatically change the scene by decentralising the application and enforcement of the EC rules on restrictive practices and abuses of dominant positions. Under the Commissionrsquo;s proposal, national authorities and judges would receive new competences in this area and would be expected to shoulder a substantially greater part of the day-to-day application and enforcement of the Communityrsquo;s competition rules. At the time of the publication of this book the adoption of the Regulation may be imminent.br br The book contains the papers that were delivered at the conference. The editors added a general introduction, setting out the highlights of the modernisation debate, as it was conducted in Leuven. The text of the Commissionrsquo;s proposal is provided as well, making this book a valuable research tool for all practitioners, academics and students that want to follow and understand the modernization process.nbsp;br
